Postignut sporazum o Kosovu: Što su dogovorili Srbija i Kosovo

BRISEL – Večernji list ekskluzivno objavljuje tekst sporazuma između Kosova i Srbije koji je danas parafiran u Bruxellesu i koji Srbima na sjeveru Kosova daje određenu autonomiju, ali istodobno, prema riječima kosovskog premijera Hashima Thacija, označava “de jure priznanje Kosova” od Srbije.

Sporazum o načelima za normalizaciju odnosa

1. Postojat će Udruga/Zajednica općina s većinskim srpskim stanovništvom na Kosovu. Bit će otvorena za članstvo bilo kojoj općini pod uvjetom da se članovi slažu

2. Udruga/Zajednica bit će stvorena statutom. Njezin raspad može se dogoditi isključivo odlukom općina koje u njoj sudjeluju. Pravna jamstva nalaze se u odgovarajućem zakonu i ustavnom zakonu (uključujući pravilo o dvotrećinskoj većini)

3. Strukture Udruge/Zajednice uspostavit će se po istoj osnovi kao i postojeći statuti Udruge srpskih općina, tj. predsjednik, potpredsjednik, skupština, vijeće

4. U skladu s ovlastima propisanima Europskom poveljom o lokalnoj samoupravi i kosovskim zakonom, općine koje sudjeluju imat će pravo surađivati u kolektivnom ostvarivanju svojih ovlasti kroz Udrugu/Zajednicu. Udruga/Zajednica imat će potpuni nadzor nad područjima gospodarskog razvoja, obrazovanja, zdravstva, urbanog i ruralnog planiranja

5. Udruga/Zajednica primjenjivat će i druge dodatne ovlasti koje joj mogu biti dodijeljene od središnje vlasti

6. Udruga/Zajednica imat će predstavničku ulogu pred središnjom vlašću i u tu svrhu imat će mjesto u savjetodavnom vijeću zajednica. U ostvarivanju te uloge predviđena je funkcija nadzora

7. Postojat će jedna policija na Kosovu koja se zove Kosovska policija. Svi policajci na sjeveru Kosova bit će integrirani u sklopu Kosovske policije. Plaće će isključivo isplaćivati KP.

8. Pripadnicima ostalih srpskih sigurnosnih struktura bit će ponuđeno odgovarajuće mjesto u kosovskim strukturama

9. Postojat će regionalni policijski zapovjednik za četiri sjeverne općine s većinskim srpskim stanovništvom (Sjeverna Mitrovica, Zvečan, Zubin Potok i Leposavići). Zapovjednik te regije bit će kosovski Srbin predložen od Ministarstva unutarnjih poslova prema listi koju će dati četiri načelnika općine uime Udruge/Zajednice. (Postojat će još jedan regionalni zapovjednik za općine Južna Mitrovica, Skenderaj i Vushtri). Regionalni zapovjednik četiriju sjevernih općina surađivat će s ostalim regionalnim zapovjednicima.

10. Pravosudne vlasti bit će integrirane i radit će u sklopu pravnog sustava Kosova. Apelacijski sud u Prištini uspostavit će povjerenstvo sastavljeno od većine K/S sudaca (K/S je kratica za kosovske Srbe, op.a.) koje će se baviti svim općinama s kosovskim Srbima kao većinskim stanovništvom. Odjel tog Apelacijskog suda, sastavljen od administrativnog osoblja i sudaca, sjedit će trajno u Sjevernoj Mitrovici (Okružni sud Mitrovice). Svako radno tijelo navedenog odjela bit će sastavljeno većinom od K/S sudaca. Odgovarajući suci jedit će ovisno o prirodi slučaja u koji su uključeni.

11. U sjevernim općinama bit će organizirani općinski izbori tijekom 2013., uz posredovanje OSCE-a, a u skladu s kosovskim zakonima i međunarodnim standardima.

12. Do 26. travnja bit će napisan plan provedbe (ovog sporazuma, op.a.) s vremenskim okvirom. U provedbi ovog sporazuma razmotrit će se i princip transparentnog financiranja.

13. Dvije strane intenzivirat će raspravu o energetici i telekomunikacijama i dovršiti je do 16. lipnja.

14. Usuglašeno je da nijedna strana neće blokirati ni poticati druge da blokiraju drugu stranu u napretku na njezinom putu prema EU.

15. Dvije strane uspostavit će odbor za provedbu (ovog sporazuma, op.a.), uz posredovanje EU.

Agreement of principles governing the normalization of relations

1. There will be an Association/Community of Serb majority municipalities in Kosovo. Membership will be open to any other municipality provided the members are in agreement

2. The Community/Association will be created by statute. Its dissolution shall only take place by a decision of the participating municipalities. Legal guarantees will be provided by applicable law and constitutional law (including the 2/3 majority rule).

3. The structures of the Association/Community will be established on the same basis as the existing statute of the Association of Kosovo municipalities e.g. President, vice President, Assembly, Council

4. In accordance with the competences given by the European Charter of Local Self Government and Kosovo law the participating municipalities shall be entitled to cooperate in exercising their powers through the Community/Association collectively. The Association/Community will have full overview of the areas of economic development, education, health, urban and rural planning 5. The Association/Community will exercise other additional competences as may be delegated by the central authorities

6. The Community/Association shall have a representative role to the central authorities and will have a seat in the communities consultative council for this purpose. In the pursuit of this role a monitoring function is envisaged

7. There shall be one police force in Kosovo called the Kosovo Police. All police in northern Kosovo shall be integrated in the Kosovo Police Framework. Salaries will be only from KP.

8. Members of other Serbian security structures will be offered a place in equivalent Kosovo structures

9. There shall be a Police Regional Commander for the four northern Serb majority municipalities (Northern Mitrovica, Zvecan, Zubin Potok and Leposavici). The Commander of this region shall be a Kosovo Serb nominated by the Ministry of Internal Affairs from a list provided by the four mayors on behalf of the Community/Association. The composition of the KP in the north will reflect the ethnic composition of the population of the four municipalities. (There will be another Regional Commander for the municipalities of Mitrovica South, Skenderaj and Vushtri). The regional commander of the four northern municipalities will cooperate with other regional commanders.

10. The judicial authorities will be integrated and operate within the Kosovo legal framework. The Appellate Court in Pristina will establish a panel composed of a majority of K/S judges to deal with all Kosovo Serb majority municipalities. A division of this Appellate Court, composed both by administrative staff and judges, will sit permanently in northern Mitrovica (Mitrovica District Court). Each panel of the above division will be composed by a majority of K/S judges. Appropriate judges will sit dependant on the nature of the case involved.

11. Municipal elections shall be organised in the northern municipalities in 2013. with the facilitation of the OSCE in accordance with Kosovo law and international standards.

12. An implementation plan including time frame shall be produced by April 26. In implementing this agreement the principle of transparent funding will be addressed.

13. Discussions on Energy and Telecoms will be intensified by the two sides and completed by Junbe 16

14. It is agreed that neither side will block or encourage others to block the other side's progress in their respective EU paths

15. An implementation committee will be established by the two sides with the facilitation of the EU
